BANJALUKA – Odluka Ustavnog suda BiH da Ukio banka ima pravo da potražuje 155 miliona KM od Fabrike glinice „Birač“ u stečaju je vrlo jasna i konkretna, a ako je nešto skandalozno, onda je to presuda Vrhovnog suda RS.

Rekao je to pravni zastupnik litvanske Ukio banke Aleksandar Sajić reagujući na tvrdnje pravnog konsultanta FG „Birač“ Vitomira Popovića da Ustavni sud BiH skandaloznom odlukom pokušava oteti 300 miliona od Srpske.
Sajić je rekao da je presuda Vrhovnog suda RS puna nelogičnosti i pogrešnih zaključaka koje jedna takva institucija ne bi sebi trebalo da dozvoli i da bi stečajni postupak u FG Birač“ davno bio završen da nije bilo „nekih čudnih interesa“.
Odluka Ustavnog suda BiH da stavi van snage presudu Vrhovnog suda RS kojom su potvrđene presude nižih sudova i odbijen zahtjev litvanske Ukio banke da im se prizna 155 miliona KM potraživanja od FG „Birač“ u stečaju izazvala je pravi verbalni rat na relaciji FG „Birač“ – Ukio banka.
Nakon što je Vitomir Popovć jutros za CAPITAL rekao da je Ustavni sud BiH ovakvom odlukom izašao iz okvira svojih nadležnosti, a sve u pokušaju da postane vrhovni sud BiH, Sajić kaže da je odluka Ustavnog suda dobro obrazložena i da ona tačno ukazuje šta je bio propust u zaključku Vrhovnog suda RS, a onda i nižestepenih sudova.
Sajić: Nadam se da će Vrhovni sud donijeti odluku zasnovanu na zakonu
Kaže da je Ustavni sud jednoglasno donio ovakvu odluku i da ne vidi da je ona suprotna interesima Srpske, kako to pokušavaju predstaviti iz FG „Birač“ s obzirom na to da se radi o stečajnom postupku nad većinski privatnim društvom.
„Ova odluka ide u pravcu okončanja stečajnog postupka i mislim da je to u interesu svima. Postoje ljudi kojima je očigledno u interesu da ovo sve traje u nedogled, ali nama nije“, kazao je Sajić.
On je podsjetio da stečajni postupka u FG „Birač“ traje osam godina i da kćerka firma „Alumina“, koja je jedino vrijedno što ulazi u stečajnu masu, posluje veoma dobro, da je u ovom periodu ostvarila oko milijardu KM prihoda, a da niko od povjerilaca nije dobio ni marke.
„Nadam se da će Vrhovni sud u roku od tri mjeseca, postupajući po uputama Ustavnog suda i bez pritisaka, za koje znamo da su postojali, donijeti odluku koja je sudska i zasnovana na zakonu, a ne na nekim drugim interesima“, istakao je Sajić.
Naglasio je i da će odluku Ustavnog suda dostaviti svim sudovima pred kojima se vode drugi postupci koji se tiču ovog potraživanja, a u kojima se odluke koje su donesene pozivaju na presudu Vrhovnog suda RS.
Ustavni sud BiH juče je poništio presudu Vrhovnog suda RS kojom su potvrđene presude nižih sudova i odbijen zahtjev litvanske Ukio banke da im se prizna 155 miliona KM potraživanja od FG „Birač“ u stečaju.
Na ovu odluku oštro su reagovali iz FG „Birač“ iz koje su ocijenili da je Ustavni sud izašao izvan svojih okvira te da on ne može da ulazi u to da li su sudovi RS proizvoljno tumačili dokaze u postupku jer to nije njegova nadležnost.
„To je jedna blamaža i u ovo bi moralo da se uključi i Tužilaštvo BiH i drugi organi. Mi smo još prije dvije godine imali indicije na koji način će biti suđeno i na koji način će oni koji budu to radili biti stimulisani. Ne bi trebalo dozvoliti da se Srpskoj na jedan bezobrazan, da ne kažem korupcionaški način, uzme 300 miliona KM“, rekao je pravni konsultant FG „Birač“ Vitomir Popović.
